These Terms of Use ("Terms") and our Privacy Policy, incorporated herein by reference, constitute a legally binding agreement between you, the user of the VisaPilotAI mobile application (respectively, "User", "you" or "your"), and Megaleios Digital Solutions, LLC("Company", "we", "us", or "our"), the legal owner and operator of the App. These Terms govern your use and interaction with the VisaPilotAI application ("App") and all services offered therein (as defined below).
By downloading, installing, accessing, or using the App, you hereby represent and warrant that you have read, understood, and agree to be bound by these Terms. If you do not agree to be bound by these Terms, or any part thereof, you must immediately cease all use of the App and Services.
1 Definitions
For purposes of these Terms, the following definitions apply:
"App" means the VisaPilotAI mobile application available on iOS and Android platforms.
"Services" means all features and functionalities provided through the App, including but not limited to: immigration case tracking, Visa Bulletin information display, AI Advisor chat functionality, push notifications, case status monitoring, and any other tools or features made available to Users.
"AI Advisor" means the artificial intelligence-powered informational chat feature available within the App that provides general, non-legal informational guidance about immigration processes and case statuses.
"Premium Plan" means the paid subscription tier of the App that unlocks additional features such as unlimited case tracking, real-time push alerts, priority support, AI analysis, personalized checklists, and PDF report exports.
"Case Data" means the immigration case information, receipt numbers, case statuses, and related data that Users input into or retrieve through the App.
"Content" means all text, data, graphics, images, and other material displayed within the App.
2 No Legal Advice Disclaimer
2.1. THE APP AND ALL SERVICES PROVIDED HEREIN, INCLUDING BUT NOT LIMITED TO THE AI ADVISOR FEATURE, DO NOT CONSTITUTE LEGAL ADVICE, IMMIGRATION COUNSEL, OR ANY FORM OF ATTORNEY-CLIENT REPRESENTATION. The Company is not a law firm, is not licensed to practice law in any jurisdiction, does not employ or retain immigration attorneys for the purpose of providing advice through the App, and expressly disclaims any and all liability arising from any User's reliance on the information provided through the App as legal counsel.
2.2. The AI Advisor feature is an automated informational tool powered by artificial intelligence. It is designed solely to provide general information about immigration procedures, case statuses, and publicly available immigration data. The AI Advisor:
(a) Does NOT provide legal advice, legal opinions, or legal recommendations of any kind;
(b) Does NOT replace the need for consultation with a qualified, licensed immigration attorney;
(c) Does NOT create, imply, or establish an attorney-client relationship between the User and the Company;
(d) Does NOT guarantee the accuracy, completeness, or applicability of any information provided;
(e) Does NOT make representations about the likely outcome of any immigration case, petition, or application;
(f) Does NOT prepare, review, or file any legal documents on behalf of Users;
(g) Should NOT be relied upon as a substitute for professional legal counsel.
2.3. You acknowledge and agree that any actions you take based on information provided by the App or the AI Advisor are entirely at your own risk and discretion. The Company strongly recommends that you consult with a licensed immigration attorney before making any decisions regarding your immigration case, filing any applications, or taking any action that could affect your immigration status.
2.4. The Company expressly disclaims any responsibility for any adverse outcomes, including but not limited to denied petitions, missed deadlines, incorrect filings, loss of immigration status, deportation, or any other negative consequences that may result from a User's reliance on information provided through the App or the AI Advisor.
3 Age Eligibility
You represent that you are at least 16 years of age and are legally eligible to enter into these Terms under the applicable laws and regulations of your jurisdiction. If you are under 16 years of age, you may not use the App or Services. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf.
4 Account Registration and Security
4.1. To access certain features of the App, you must create an account by providing your full name, email address, and a password. You may also be asked to provide additional information such as your phone number when editing your profile.
4.2. You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security. The Company will not be liable for any loss or damage arising from your failure to protect your account information.
4.3. You represent and warrant that all information provided during account registration and throughout your use of the App is accurate, current, and complete. You agree to promptly update your information to maintain its accuracy.
5 Consent to Access and Use of Case Data
5.1. By using the App and entering your USCIS receipt number(s) or any other immigration case identifiers, you expressly consent to and authorize the Company to:
(a) Access publicly available case status information from USCIS and other government databases on your behalf;
(b) Store, process, and display your Case Data within the App for the purpose of providing the Services;
(c) Monitor your case status periodically and send you notifications regarding updates or changes;
(d) Use your Case Data in an anonymized and aggregated form for analytical and statistical purposes, including improving the Services;
(e) Process your Case Data through AI systems, including the AI Advisor, to generate informational responses about your case status and general immigration procedures.
5.2. You represent and warrant that: (a) you are the rightful owner of, or have proper authorization to access and share, any Case Data you input into the App; (b) your use of the App to access case information complies with all applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA); and (c) you are not inputting case data belonging to third parties without their explicit consent.
5.3. You acknowledge that the Company accesses your case information through publicly available government sources and does not have privileged access to any government systems. The accuracy and availability of case information are dependent on the functionality and data provided by these third-party government sources, over which the Company has no control.
5.4. You may revoke your consent to the storage and processing of your Case Data at any time by deleting your account through the App's profile settings or by contacting us at the email address listed in the Contact section below. Upon revocation, the Company will delete your Case Data within 30 days, except as required to comply with legal obligations or to resolve disputes.
6 The Services, License, and Intellectual Property
6.1. The Company offers the App for installation on iOS and Android mobile devices through the Apple App Store and Google Play Store ("App Stores"). The App enables Users to track and monitor their immigration case statuses, access Visa Bulletin data, receive notifications, interact with the AI Advisor, and use other informational tools (collectively, the "Services"). Your use of the App shall comply with all applicable App Store policies and agreements.
6.2. Subject to these Terms, the Company grants you a revocable, limited, non-exclusive, non-transferable, non-assignable, and non-sublicensable license for personal, non-commercial use to access the App and use the Services solely for the purposes described herein.
6.3. Except as expressly stated herein, the Company retains all rights, title, ownership, and interest in and to the App, the Services, copyrights, trademarks, logos, trade names, proprietary technology, AI models, and all associated intellectual property. All rights not expressly granted herein are reserved by the Company.
6.4. It is hereby clarified that any USCIS case information displayed within the App is derived from publicly available government sources. The Company does not claim ownership of government-sourced case data and does not have the authority to modify information derived from government records.
7 Subscription Plans and Payments
7.1. The App offers a free tier with basic case tracking features (limited to one process) and a Premium Plan with enhanced features. The Premium Plan is available at the pricing displayed within the App at the time of purchase and is billed on a recurring monthly basis through the applicable App Store.
7.2. Premium Plan features may include, but are not limited to: unlimited case tracking, real-time push notifications, AI-powered case analysis, personalized checklists, PDF report exports, and priority customer support.
7.3. All subscription purchases are processed through and subject to the terms and policies of the applicable App Store, including their respective refund policies. The Company does not directly process payment information.
7.4. You may cancel your Premium Plan subscription at any time through the App's subscription management settings or through your App Store account. Cancellation will take effect at the end of the current billing period, and you will retain access to Premium features until that period expires.
7.5. The Company reserves the right to modify pricing, features, or the availability of any subscription plan at any time, with reasonable notice to active subscribers.
8 Third-Party Advertisements
8.1. The free tier of the App may display advertisements from third-party advertising networks, including Google AdSense ("Third-Party Ads"). These Third-Party Ads are subject to separate terms of use and privacy policies provided by the respective third parties.
8.2. The Company does not endorse, warrant, or assume responsibility for any products, services, or content advertised through Third-Party Ads. Your interaction with any Third-Party Ads is at your own risk and is governed by the third party's applicable terms.
8.3. Premium Plan subscribers may experience an ad-free or reduced-ad experience as part of their subscription benefits.
9 Visa Bulletin Information
9.1. The App provides access to Visa Bulletin data, including Final Action Dates and Dates for Filing for employment-based and family-based visa categories. This information is sourced from the U.S. Department of State's publicly available Visa Bulletin publications.
9.2. The Visa Bulletin information displayed in the App is provided for informational purposes only. The Company does not guarantee the accuracy, timeliness, or completeness of Visa Bulletin data. Users should always verify Visa Bulletin information directly with the U.S. Department of State at travel.state.gov.
9.3. The Company is not responsible for any actions taken by Users based on Visa Bulletin information displayed in the App, including but not limited to decisions to file or not file immigration applications.
10 Push Notifications and Communications
10.1. By using the App and enabling push notifications, you consent to receive notifications regarding case status updates, document approvals, appointment reminders, subscription information, new features, and other App-related communications.
10.2. You may disable push notifications at any time through your device settings or the App's notification preferences. Disabling notifications may limit the functionality of certain Services.
11 Restrictions of Use
You agree that you will not, directly or indirectly:
(a) Copy, modify, adapt, disassemble, translate, decompile, reverse engineer, or attempt to derive the source code of the App or any part of the Services;
(b) Circumvent, disable, damage, or otherwise interfere with security-related features of the App;
(c) Use the App or Services for any fraudulent, unlawful, or unauthorized purpose;
(d) Use automated means, bots, scrapers, or scripts to access the App or Services;
(e) Reproduce, distribute, or create derivative works based on the App or Services without prior written consent;
(f) Use the Company's name, logo, trademarks, or intellectual property without prior written consent;
(g) Input false, misleading, or unauthorized case data into the App;
(h) Attempt to gain unauthorized access to other Users' accounts or data;
(i) Use the App to collect, store, or transmit personal information of other individuals without their consent;
(j) Use the AI Advisor or any output generated by it to provide legal advice to third parties or represent it as professional legal counsel.
12 Data Privacy and Security
12.1. Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information and Case Data. By using the App, you consent to the data practices described in the Privacy Policy.
12.2. The Company implements commercially reasonable technical and organizational security measures to protect your personal information and Case Data. However, no method of transmission over the internet or electronic storage is 100% secure, and the Company cannot guarantee absolute security.
12.3. You acknowledge that the AI Advisor processes your Case Data and conversation inputs to generate informational responses. Conversations with the AI Advisor may be stored for quality assurance and service improvement purposes. You should not share sensitive personal information, such as Social Security numbers, financial account numbers, or passwords, through the AI Advisor chat.

15 Indemnification
15.1. You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all third-party claims, damages, obligations, liabilities, losses, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the App and Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any infringement of third-party rights, including intellectual property or privacy rights; or (e) any unauthorized or inaccurate Case Data submitted by you.
15.2. This indemnification obligation shall survive the termination or expiration of these Terms.
16 Term and Termination
16.1. These Terms are effective upon your first use of the App and continue until terminated by either party.
16.2. You may terminate these Terms at any time by deleting your account through the App's profile settings ("Close my account") and uninstalling the App from your device.
16.3. The Company may terminate or suspend your access to the App and Services at any time, with or without cause and with or without notice, at its sole discretion. Grounds for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or abusive behavior.
16.4. Upon termination, your right to use the App ceases immediately. The Company may delete your account data and Case Data, subject to applicable legal retention requirements. All sections of these Terms which by their nature should survive termination shall survive, including but not limited to Sections 2, 13, 14, 15, and 18.
17 Amendments
The Company reserves the right to modify, update, or revise these Terms at any time at its sole discretion. Material changes will be communicated to Users through the App or via email notification at least thirty (30) days prior to taking effect. The date of the last revision will be reflected in the "Last Modified" date at the top of these Terms. Your continued use of the App after the effective date of any amendments constitutes your acceptance of and agreement to the revised Terms.
18 Governing Law and Dispute Resolution
18.1. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
18.2. Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Orange County, Florida, and you hereby consent to the personal jurisdiction of such courts.
18.3. Any claim arising under or relating to these Terms must be brought within twelve (12) months after the cause of action arises, or such claim shall be permanently barred.
19 Change of Ownership
In the event of a merger, acquisition, reorganization, or sale of all or substantially all of the Company's assets, your data and account information may be transferred to the successor entity. Active subscribers will be notified prior to any such transfer. If the successor entity's privacy practices differ materially from those described in our Privacy Policy, Users will be notified and given the opportunity to delete their accounts and data prior to the transfer.
20 Miscellaneous
20.1. Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the App and Services, superseding all prior agreements and understandings.
20.2. Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
20.3. Waiver. The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
20.4. Assignment. You may not assign or transfer these Terms or any rights hereunder without the prior written consent of the Company. The Company may assign these Terms and delegate its obligations at its sole discretion.
20.5. Force Majeure. The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, internet outages, third-party service failures, or changes to government systems or APIs.
